    Fair play to the bloke. I can't see how the bfc can stop anyone from starting a new club with Barnsley in it some Where if they are the football league rules shaw lane must abide by.

    It's no more than damage limitation. If he is so stupid that he thinks the fans of a football club he has insulted wouldn't be offended, then god help him.

    Also, what are Barnsley F.C. doing wrong regarding the name? It's no different to what Apple would do if a tech company set up a business and when it got to a certain size changed it's name to "Apple Seed"(for example). They would fight tooth and nail to keep the identity they have built up from scratch.

    As for building a "working relationship", the benefit would greatly favour his team, due to the level they play at. Also, I'd think that one of the benefits a club would look for when sending their young players out on loan is to give them experience of living independently. By going on loan to a club across town would not achieve this.

    It's not the same at all though really, is it? I don't really want them to have Barnsley in their name as I'm a Barnsley FC supporter but we have no god given right to being the only club in the town with that name. We didn't invent the convention of naming a football club after the town, pretty much all professional clubs take the name of the town/city where they are based whereas in technology, companies tend to come up with their own, unique names. They shouldn't be allowed a name that is too similar e.g. AFC Barnsley as people could get genuinely confused but there's no reason they shouldn't be able to be called Barnsley Shaw Lane for example. The way we compete is just by being better than them, same as any town or city with two clubs have to do. I don't want it to happen but your example isn't the same thing at all.

    He gambled and lost. He said that we would sign a certain player or something and that if we didn't he would become a Wednesday fan. Said player never signed so his avater is now in Wednesday colours.

    Wasn’t the Cryne backed breakaway club actually called AFC Barnsley? I don’t recall any confusion or objection at the time.

    I don't know, my point was just that his Apple example wasn't the same as technology companies don't follow a naming convention the same as football clubs do.

    Of course it's the same. The rules state another club can not set up with a name similar to another already established club(F.A. rules apparently). So, like you say, AFC Barnsley could be construed as being too similar as Barnsley F.C. Just like if I set up a company selling phones as "Apple Seed" phones, the chances are the lawyers would construe the name as being too similar to "Apple Inc." under copyright laws.

    The original post wasn't about who was right or wrong though, or if the naming issue was same as a corporate copyright case. It was more about the rights of Barnsley Football Club to defend the use of the word "Barnsley" with regards to football clubs in the area. The example was simply a way of showing my thinking behind the post..

    I thought AFC Barnsley were set up in anticipation that Barnsley FC were going to go out of business so there would still have been a phoenix club called Barnsley.
